Our general terms and conditions

1. Scope of Application

These General Terms and Conditions (AGB) apply to all business relationships between DIE HOLZBLÄSER Musikinstrumente und Zubehör GmbH and its customers, unless otherwise agreed in writing. Sales and rentals are exclusively conducted in the store, via telephone, or via email order. There is no online shop in the legal sense. The website is for informational purposes only.

2. Offer and Conclusion of Contract

Our offers are non-binding and subject to change. A purchase or rental contract is concluded only when we accept the order in writing or orally or when we execute the order.

3. Delivery and Shipping

Delivery will take place promptly according to the agreement with the customer. Events of force majeure, strikes, official orders, and other unavoidable circumstances relieve us from the obligation to deliver for the duration of their effect.

Shipping is at the recipient’s expense. Current shipping costs can be found in our price list, which is available here.

Shipping Abroad: International shipping is only possible with prepayment. All customs duties, import fees, and handling charges, as well as any applicable taxes and levies in the destination country, are to be borne by the customer. These costs are not included in our invoices and must be paid by the recipient locally. We are not liable for any delays in international shipping caused by customs clearance or other country-specific regulations.

4. Trial and Test Sets

Trial shipments (instruments, mouthpieces, plastic reeds) will be made by prior arrangement for a specified period. For this service, we charge a processing and shipping fee.

The items must be carefully handled and returned in their original packaging. Removed labels, damaged, or dirty items cannot be returned and will be charged to the customer.

Mouthpiece Test Sets: For each mouthpiece, we charge a test fee of €2.00. When purchasing a mouthpiece from the selection, up to 5 test fees (maximum €10.00) will be credited. The return must occur by the date indicated on the delivery note; otherwise, a deduction of 1% of the item value will be applied for each subsequent day.

5. Complaints and Warranty

Transport damages must be reported to the carrier immediately. Other complaints must be submitted in writing to us within 8 days after receipt of the goods. In case of justified defects, we will, at our discretion, either replace the goods or repair them.

6. Retention of Title

The delivered goods remain our property until full payment has been made.

7. Payment

Invoices are due for payment within 8 days from the invoice date without deduction. No discount is granted.

8. Place of Fulfillment and Jurisdiction

The place of fulfillment for delivery and payment is Berlin. The exclusive place of jurisdiction is Berlin, as far as legally permissible.

9. Right of Withdrawal for Distance Contracts

Since there is no online shop, and orders are placed by phone, email, or in person, the regulations on distance selling apply only to orders made via remote communication.
 
Consumers have the right to withdraw from the contract within 14 days of receiving the goods. The goods must be returned unused and in their original packaging. Reeds can only be returned if unopened. Videos, CDs, DVDs, books, and sheet music are excluded from exchange.
 
The return shipping costs are borne by the customer. We do not accept unfree shipments. In case of a justified complaint, we will refund the shipping costs.

10. Rent-to-Own and Instrument Rental

Additional rental terms and conditions apply to rent-to-own agreements and instrument rentals, which are provided and explained at the time of contract conclusion.

11. Consignment Sales

DIE HOLZBLÄSER Musikinstrumente und Zubehör GmbH sells used instruments on behalf of customers on a consignment basis. A separate consignment agreement is concluded between DIE HOLZBLÄSER Musikinstrumente und Zubehör GmbH and the consignor, which regulates the details.
 
The selling price is agreed jointly. The commission is 15% of the sale price plus 19% VAT on the commission fee.
 
The consignment goods remain the property of the consignor until sold. DIE HOLZBLÄSER Musikinstrumente und Zubehör GmbH is not liable for damage, loss, or theft of the goods unless caused by intent or gross negligence.
 
The commission claim arises with the sale of the goods. The sales proceeds, less the commission fee and any agreed costs, will be paid to the consignor after the payment has been received from the buyer and the corresponding accounting process is completed. There is no entitlement to immediate payment.
 
Consignment goods can be reclaimed by the consignor at any time before the sale, provided they have not yet been sold.

12. Repair Service

Instruments for repair are accepted by arrangement. Cost estimates are non-binding. For repair orders, individual agreements regarding scope, price, and pick-up dates apply.

13. Liability

The customer is liable for damages caused by improper use, unauthorized repairs, or insufficient packaging when returning goods.

14. Data Protection

Personal data will be collected, processed, and used only in accordance with the legal provisions. Further information can be found in our privacy policy.
